Preobrazhensky District Court of Moscow Orders City Property Department (DGI) to Sign Social Tenancy Agreement with Capital Resident After 20-Year Struggle

The court ruled in favor of a Moscow woman who had been unable to legally secure her right to housing for over 20 years. The case was successfully resolved thanks to the expert representation of Mamed Aliyev, lead lawyer at Palulin & Partners.

Case Background: 37 Years on the Waiting List and Broken Promises

The client’s family had been on the housing registry since 1988, and their apartment was deemed dilapidated. In 2000, they were temporarily relocated but never granted a social tenancy agreement, leaving them in legal limbo.

Despite multiple appeals to the DGI, the woman faced rejections under various pretexts:

The department cited a waiting list of 1,786 families;
Ignored her priority right to housing;
Attempted to invoke the statute of limitations, even though the violation was ongoing.

Mamed Aliyev, representing the client, stated:
"Our client’s family had a priority right to housing since their previous apartment was declared uninhabitable. Placing them in the general queue was a direct violation of housing laws. The DGI avoided its obligations for years, but the court confirmed: such cases have no expiration date."

On May 14, 2025, the court fully upheld the claim, ordering the DGI to:
✔ Sign a social tenancy agreement with the plaintiff;
