Legal professionals often encounter cases where the outcome depends on a forensic expert opinion. It would seem that a lack of specialized technical knowledge limits the ability to influence the process. However, using a recent case in the Golovinsky District Court of Moscow as an example, we demonstrated that a competent legal analysis can dramatically change the outcome, even in complex disputes over compensation.

Case Summary
The client contacted us after a flood in their apartment caused significant property damage. The defendant commissioned a forensic expert opinion, which significantly underestimated the actual cost of restoration work. Our goal was to challenge this opinion and obtain fair compensation.

Identified Errors in the Expertise
We reviewed the opinion in detail and discovered critical errors:

     1.Ignoring Associated Costs
     The expert noted the "economic inexpediency" of repairing the furniture and recommended purchasing new furniture, but failed to consider the cost of                     dismantling, removing, and disposing of the damaged property.

     2.Omission of Key Damage Components
     The calculations completely omitted the cost of damaged interior doors, despite their irreversible damage having been previously confirmed.

     3.Unjustified Underpricing
     The expert used estimates from other regions of Russia without taking into account Moscow market prices or logistics costs for material delivery.

"Palyulin & Partners" Lawyers Tactics
Instead of commissioning an expensive review, we chose a targeted strategy:

    We cross-examined the expert in court, focusing on the internal contradictions in the report;

    • Prepared legally sound objections, highlighting violations of the calculation methodology;

    • Convinced the court of the need for an additional expert assessment without engaging third-party reviewers.

Result
• Despite the opponent's claims of "insignificant discrepancies" (10,000-15,000 rubles), the additional expert assessment increased the compensation amount by 250,000 rubles. This was made possible by:
• - Including previously overlooked items (doors, dismantling) in the calculation;
 - Using current Moscow rates;
• - Accurate accounting of logistics costs.

"A lack of specialized knowledge often limits the ability to influence the progress of claims related to road accidents, flood damage, construction work, etc. Nevertheless, a lawyer should not neglect the case."
