Successful completion of a citizen's bankruptcy case – a victim of fraudsters
The Arbitration Court of the Moscow Region issued a ruling on the full completion of our client's asset sale procedure and his release from further fulfillment of obligations to creditors. The uniqueness of this case lies in the fact that the client became a victim of fraudsters, and all credit obligations were incurred by him while under the influence of a delusion. Magomedali Aliev, Head of the Bankruptcy Practice at the law firm "Palulin and Partners," who handled the case, noted that the court established the absence of signs of fictitious bankruptcy, and the financial manager confirmed that all the debtor's transactions were bona fide.
The bankruptcy procedure took only 13 months from the filing of the application to its full completion. During this short period, we managed to achieve the write-off of 7,190,007 rubles of debt, which will no longer burden our client. It is important to emphasize that the court thoroughly examined all the circumstances surrounding the incurrence of the debt and found no grounds for refusing to release the client from obligations.
The key aspect of the success was proving that the client had acted under the influence of a delusion, which excluded the possibility of the bankruptcy being deemed intentional. During the procedure, a register of creditor claims was formed, a comprehensive analysis of the debtor's financial condition was conducted, and the financial manager carried out all necessary measures to locate and sell assets. "The court has not established any circumstances that would prevent the debtor from being released from the obligations claimed during the bankruptcy procedure," reads the text of the judicial act.
This case clearly demonstrates that even in complex situations where a citizen falls victim to fraudulent schemes, the law provides an opportunity for full release from debt burden through the bankruptcy procedure. The lawyers at "Palulin and Partners" provided their client not only with legal protection but also with the possibility of financial recovery, freeing him from an unbearable debt load exceeding seven million rubles.
