Lead Lawyer Mamed Aliyev Resolves a 37-Year-Long Housing Improvement Case for a Moscow Resident!
Professional recognition at the national level and success in a highly complex legal dispute go hand in hand. In December 2023, an authoritative study of the legal services market conducted by "Rossiyskaya Gazeta", the official publisher of government documents, singled out Mamed Aliev, Lead Attorney of the law firm "Palyulin & Partners." A housing deadlock lasting two decades: a family in an emergency building left without rights
The story with which the client approached us is a classic example of how a human situation cannot be resolved for years due to bureaucratic obstacles. The family had been on the housing waiting list since 1988, and after their apartment was declared unsafe, they were temporarily relocated to neighboring housing. The critical mistake was the failure to timely execute a social tenancy agreement for the new premises. As a result, since 2000, none of the lawful opportunities to obtain housing had been realized. Despite the woman's repeated appeals, the Moscow Department of City Property (DGI) responded with refusals each time, the last of which was justified by the family being on a general waiting list of 1,786 families.
Legal strategy: breaking the bureaucratic circle through direct application of the law
Mamed Ahmedovich carefully analyzed the history of the issue and developed a strategy based on impeccable knowledge of housing legislation and judicial practice. The position was built on several key arguments. First, the law in such cases clearly establishes the obligation to provide housing under a social tenancy agreement out of turn, which completely ruled out the department's references to the length of the queue. Second, the defendant's arguments regarding the expiration of the statute of limitations were rebutted, since the violation of our client's rights was ongoing — she continued to reside in the premises without proper legal formalization. Third, it was proven that, having moved into the apartment back in 1995 and using it for its intended purpose, the woman had in good faith fulfilled her part of the obligations, while the duty to execute the agreement lay precisely with the Moscow DGI.
Outcome: justice restored and expert status confirmed
On May 14, 2025, the Preobrazhensky District Court of Moscow issued a ruling fully satisfying our claims and obliging the Department of City Property to conclude the long-awaited social tenancy agreement with the client. This victory restored the legal rights of a person who had been in legal limbo for over 20 years. Success in such complex and socially significant cases formed the basis of professional recognition. Awarding Mamed Aliev the third category in the Rossiyskaya Gazeta ranking objectively reflects his deep expertise in resolving court disputes and his ability to achieve results even in the most tangled situations.
